154- 2014 Article VII Payment Notice to Counties

Dear Colleague:

The enacted SFY 2014-15 New York State Budget includes legislation that allows for payment of specific claims to providers of Early Intervention (EI) services.  Applicable claims are those submitted to third-party payers, including Medicaid, from 4/1/13 to 6/30/13, for which no payment or determination has been made.  Payment of these claims will be funded by municipalities through their EI escrow accounts and processed by the State Fiscal Agent (SFA).  

A special invoice that includes the amount needed to cover these claims will be sent to each municipality.  The SFA will be sending each municipality the estimated dollar amount to cover the payments.  

The legislation requires that payment be made to affected providers on the 45th day following the date the budget was enacted.  Therefore, the SFA will issue payment to providers for these claims on May 16, 2014.   Municipalities will be required to pay the special invoice upon receipt but no later than Friday May 9^th to ensure that the escrow account is sufficiently funded. 

Please note that in addition to this special invoice, Municipalities are still required to meet their obligation to fund the escrow account for EI claims currently being submitted and processed.
